If you're in Alabama and you're sitting behind the wheel, you're DUI. It doesn't matter if the keys are in the ignition, on the dash, or at the bottom of the river you just drove across.

This is DUI'ing 101, leave the scene, although they can charge you for that, your lawyer can argue that you became intoxicated after.

Yup, this is the case almost always. Had a friend back in the day get a DUI for sleeping in his car(back seat) in the bar parking lot.

This is in MS, and yes it does work.


So how do you beat the licence suspension required for refusing the chemical test as required under Mississippi's implied consent law?

It doesn't require a DUI charge, just a refusal to blow.

My father in law and his buddies were trashed and driving drunk for his bachelor party, got caught, PD called in a motorcycle cop to escort them to the strip club

Worked a motorcycle wreck (vollie fire/ems) once where the guy who had a broken leg and multiple lesser injuries claimed he was in so much pain after the accident, he'd had a couple of drinks to take the edge off.

Everyone knew he was lying, but he was the only one hurt, his leg was seriously messed up and when he went to trial a few months later he still couldn't put any weight on it and hadn't been able to work (did some kind of manual labor). The judge basically said "I know you're lying, but you're not going to be driving anywhere for a long time anyhow" and let him plead to reckless driving.

You don't.

But a DUI is expensive and can hurt your chance at employment. You're better off taking the suspension and working around that

Or you can spin the car around to face the cop car before he can get your license plate, get out of the car, shoot the cop, then torch his car along with his dash cam and haul arse outta there

Totally agree, frick the people in this thread trying to avoid taking responsibility.

Guarantee they're the same people who whine about that kind of stuff regarding public aid.

I didn't post this crap to encourage it. I posted it because of the sheer stupidity of the media to basically tell you how to get away with it. I hope no one drinks and drives, period.

Well by law I cannot be judged by a failed field sobriety test. My neurological disorder will cause me to fail every single time sober or drunk. If they tried I'd force legal action and the case would be thrown out before it ever reached a courtroom.

I'm amazed at the number of people here that are basically OK with drinking and driving. You're the assholes that are OK with risking the rest of our lives.

Don't want a DUI? Don't drink and drive. That simple.

I don't think anyone is condoning drunk driving, i.e. DWI, but many people believe our DUI laws, thanks in large part to many political influences (MADD and DUI lawyer lobbyists, local P.D. revenue generation, high profile media stories, etc.) are a bit excessive.

We are talking about .08 BAC, which many average Americans can reach at dinner with a few glasses of wine/beer.

Compare that to texting/using phone while driving, eating in the car, fiddling with radio/gps, prescription medication, adderal/sleep deterrents many truckers use, etc, and I think you have similar levels of distraction.

I am for strict and harsh penalties for DWIs, but most DUIs are just part of a revenue generating sting for local PDs which greatly benefits the local gov'ts and lawyers.

I'm not ok with it, nor do I partake in it. To easy to find a ride, taxi, uber Ect.

I'm just stating that if an officer attempted to arrest me for a DUI based on a field sobriety test, then it would never hold up. I can be 110% sober, and I will fail.
