Until we finally genetically engineer super-intelligent chimps, Bama fans still have to be sentient, consenting adult human beings to enter into a contract of this sort. (No, employment contracts aren't the same sort of animal, and those are actually heavily regulated for non-emancipated children under the age of 18.) I'm not sure this "Federalist Papers" writer is being serious, because that's a really glaringly obvious point to overlook when writing his article.
Is it possible that this is satire? Situational irony? I can't see any other reasonable explanation for why someone writing for a site named after a seminal document in the history of expansion of individual liberties would write something like this.
