The guy was baiting the cop. Said Cop should have realized what the guy was doing and just walked away. Instead, he proves the point the guy filming is trying to make and violates his rights by arresting him for no reason whatsoever. Cops just need to be smarter, period.

I'd need the back story on why he was being detained. If he was not lawfully detained, then the officer has no right to demand that he identify himself, either verbally or with tangible identification. Assuming that VA law is the same as Texas, I think that the dude's subtitles may have been misleading. I seriously doubt that you have to be under actual custodial arrest before you're required to provide identification. The standard traffic stop would be an example. If a person is stopped for speeding (which you can't be arrested for in Texas) and refuses to provide identification because they're not "under arrest", then they'll be placed under arrest for Failure to Display DL.
