Can a virus be patented?

Rockefeller Foundation owns patent rights of Zika Virus.

It depends. Is the virus found naturally in nature, or is it a virus that has to be created in a lab. If found naturally, then no (would be like patenting an animal you discover then). If created in a lab / not created n nature naturally, then yes it is patentable. It is a little more complicated then this, but this is the basics

Not sure what's going on with zika. Tdap vaccine is also suspected of causing the birth defects but nothing's been proven yet. Strange story.

The virus isn't patented, they just sell it.

The ATCC is a central repository for biological materials including bacteria, human cell lines, and viruses. Where do you think scientists get the material to study pathogens, they buy them.

Now I can't speak to the royalties part but the guy listed was probably the first to isolate it and then deposited with the ATCC. He worked with the Rockefeller Institute of Medical Research.
