I'd say he will be as it looks pretty clear he deserted but then he became a prisoner within about 30 mins. That said, I doubt the amount of time you deserted matters in a case like this as far as conviction goes but it may matter in terms of the sentence.
I honestly don't know what we can do to him that could possibly be any worse than what the terrorists who had him did. Damn fool has already caused plenty of his own punishment at their hands.

Put him in general population at Gitmo, if there is such a thing. If not, just change the rules to make shower time for Bergdahl communal.
