Insufficient evidence.

If this turns out to be true, I hope they realize what a massive and undeserved break they got and use the second chance to change whatever values they're using in their decision making process.

You don't know that it's undeserved.

Does anyone think they will still be suspended?

I hope Nick Saban sat them down and told them that if they farted in the wrong direction for the next year, they would be off the team.

Well, I owe Hootie and Cam an apology. I thought if the charges were true, that they should be kicked off the team. I assumed they were true. I should have just let the process play out. I was wrong.

They had the drugs and they had the guns. They were the only people in the car.

That's a 100% slam dunk possession conviction anywhere in the US (other than the places that have made marijuana legal).

They got off with a complete walk because they're college football players. The DA didn't even try to hide his real reason. Here's his exact quote: "I want to emphasize once again that the main reason I'm doing this is that I refuse to ruin the lives of two young men who have spent their adolescence and teenage years, working and sweating, while we were all in the air conditioning."

LINK

That is the complete and absolute definition of an undeserved break. I'm not hating on them for getting it. Prosecutors have the discretion to treat people differently based on what they think is in the best interests of justice.

As was pointed out in many threads, they could have been charged with another felony each and faced the very real possibility of Louisiana state prison so I said in my post, I hope they learn to make much better decisions in the future. If they don't, they might not be nearly as fortunate in the future.

I think there's 0 doubt they were true. The DA simply decided not to pursue prosecution. If you'll read his quote, he makes it pretty clear his reasons weren't really evidence related.

i wonder if some of the evidence was tainted and instead of admitting that they make up this statement. Cuz if something is tainted and thrown out then they truly have a lack of evidence?

This may approach the Cam fallout or the day the rant stalked the stripper in BHM.

It is always possible, but if that were the case I don't think the DA would have made the statement that he did. He'd catch a lot less flack for simply saying "there was a problem with the evidence" than he's going to catch for saying what he did.

I'm totally guessing, but I think his statement is probably just the truth. He saw that two kids with no criminal history but a history of a strong work ethic came back home (where one had a very sick mother) and did something stupid but harmless. He's probably got hundreds of cases with victims that suffered real harm and thus decided that this wasn't worth the resources it would require - and there's nothing wrong with him making that decision for those reasons. That's what prosecutorial discretion is all about.

One thing I will add - I'd say this probably means Cam could demonstrate that he really didn't know the gun was stolen. That's a lot more serious than a couple of kids smoking weed.

You're right. I've just been working for a prosecuting agency for about 16 years.
