No, you are misunderstanding. He was convicted of a rape that occured last year. The sentencing enhancement came from the previous conviction in 1976. I will say it is unusual for an enhancement to be added for a near 50yo conviction but I have zero issue with it being included in sentencing in the case of child rape.
